BROOME TIME: RECHARGE BETWEEN SWINGS PROMOTION

TERMS & CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions.  Any entry not complying with these Terms and Conditions is not valid. Participation in this Broome Time: Recharge Between Swings promotion (the Competition) (“Promotion”) is deemed acceptance of these Terms and Conditions.  
  1. The Promoters are Tourism North West Inc [ABN 24 772 721 131] trading as Australia’s North West Tourism, 10 Frederick Street, Broome, Western Australia and and Aviair Pty Ltd trading as Nexus Airlines [ABN] (the Promoters).
  1. Entry is open to Pilbara residents over 18 years of age. Employees of the Promoters, the Promoters’ associated companies, the Promoters’ agencies associated with this competition and their immediate families are ineligible to enter. 
  2. The Competition begins on Friday 29 November 10am AWST (Australian Western Standard Time) and ends on Monday 9 December at 5pm AWST (Australian Western Standard Time).
  1. To enter, Eligible Entrants must complete the following steps during the Promotional Period: 
  1. All entries are via the website www.australiasnorthwest.com or affiliated sites or apps with back links to www.australiasnorthwest.com; 
  1. Complete the required entry form to the “Broome Time: Recharge Between Swings” promotional competition;  

 and  

  1. Submit entry by clicking on the ‘enter now’ button.  
  1. By subscribing to our newsletter you agree to receive email from us. The subscription to our newsletter service is not mandatory, and you have the option to unsubscribe or change your subscription at any time. Your email data will never be sold or shared with a company other than the Promoters.  

Winner Selection  

  1. The prize winner will be drawn at random from the valid entries at the end of the Promotional Period. The Promoter will conduct the prize draw at 10am Western Australia Standard Time on Wednesday 11 December 2024 at the offices of Australia’s North West Tourism, 10 Frederick Street, Broome, Western Australia.  
  1. The prize winner will be notified via their contact details as submitted at the time of competition entry within two (2) business days of the draw. The winner will have their details published on www.australiasnorthwest.com and via the Promoter’s social media networks.  

Second Chance Draw and notification  

  1. If the prize remains unclaimed for 1 week after the draw, despite the Promoter’s best efforts to contact the prize winner, then the Promoter may conduct an unclaimed prize draw at the same time and place as the original draw to distribute the unclaimed prize. The first valid entry announced will win the prize. Any winner in such a draw will be notified via their contact details as submitted at the time of competition entry within two (2) business days of the draw. The date for the redraw will be 1 week after the original draw.  The redraw prize selection process will take place on 18 December 2024 if required. 

Prize Conditions 

  1. There is one (1) prize to be won. Details of the prize itinerary and inclusions are included in the Schedule to these terms and conditions.  
  1. The promoter reserves the right to amend the specification of the prize or offer an alternative prize of equal or greater value, subject to any written directions from a regulatory authority. 
  1. The Prize Winner must be available to redeem the Prize within the date/s specified in the Schedule or as communicated to them in writing by the Promoter in the event of an amendment. If the Winner is not able to redeem the Prize within the specified date/s, the Promoter may determine another Winner in its absolute discretion. 
  1. If the Prize involves tickets to an event or travel, the Promoter is not responsible for any change in times or dates, cancellations or rescheduling of events that may prevent the Prize Winner from redeeming the Prize or any part of it. 
  1. The prize is not transferable or exchangeable and cannot be redeemed for cash.  
  1. Prize winners are responsible for all costs not expressly listed as being included in the prize, including without limitation, meals, entertainment, other travel and accommodation, transfers, passports, visas, re-entry permits, spending money, freight, excess baggage, government taxes, departure taxes, ground transportation any tax liabilities, airport charges, any applicable surcharges and any other related costs. Travel insurance is not included in the prize and will be the responsibility of the winner(s). Travel insurance is highly recommended to protect against any additional costs incurred in the event of unforeseen circumstances. 
  1. Travel arrangements to and from the departure airport do not form part of the prize and are the responsibility of the winner. 
  1. The prize winner and their travelling companion must travel on the same flight as each other to their destination. 
  1. It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at any hotel/accommodation to cover all incidentals they may incur during their stay at that hotel/accommodation. For the avoidance of doubt, the Winner acknowledges that the accommodation part of the prize includes room charges only and no ancillary costs such as room service.  
  1. The Promoter accepts no responsibility for any loss, damage or injury incurred to enter the Competition or in connection with taking up the prizes.  Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal or permanent injury or loss of life; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.  The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes. 
  1. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that there are any changes to the travel itinerary.  

General Terms and Conditions 

  1. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.  
  1. If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.  
  1. One entry per person. If you attempt to obtain entry by using multiple/different email addresses, identities, registrations, or logins, or through any other methods, the Promoter may exclude you from participating in the Competition.. 
  1. The Promoter reserves the right to request proof of identity, proof of Australian residency status at the nominated Prize delivery address and proof of entry validity, in order to claim a Prize. Acceptance of proof of eligibility is at the discretion of the Promoters. In the event that an entrant cannot provide proof, their entry will be deemed invalid. 
  1. The Promoters take no liability for any tax issues which may arise from accepting a Prize in this Promotion. Consult an independent tax adviser if this is a concern. 
  1. All entries become and remain the property of the Promoters. 
  1. Entrants consent to their full names and/or their entries being used in all media by the Promoters. Entrants acknowledge and agree they may be required to participate in promotional activities while taking up the Prize. 
  1. All details of the entrants will be used and preserved in accordance with the Australian Privacy Principles and the Promoters Privacy Policies. 
  1. If the Competition is conducted on, or utilising, social media including, without limitation Facebook, Instagram and Twitter, the Competition shall be subject to the terms of use governing the applicable social media platform.
  2. Without prejudice to clause 29 above, if the Competition is conducted on Facebook or Instagram, entrants:
  1. fully release Facebook or Instagram from all liability arising out of the Competition;
  2. acknowledge that the Competition is in no way sponsored, endorsed, or administered by, or associated with, Facebook or Instagram; and understand and accept that information disclosed in connection with the Competition is disclosed to the Promoter and not Facebook or Instagram.

 

Schedule

The Prize is not subject to negotiation and not valid between 21 December 2024 and 4 January 2025. The prize is valid to 30 March 2025. Not redeemable for cash.  Bookings are subject to availability. Car hire is subject to Car Hire Terms and Conditions.  Car hire insurance is to be provided by and is the responsibility of the winner of the competition. Accommodation is subject to Seashells Broome availability and Terms & Conditions.  

 

Broome Time: Recharge Between Swings Prize 

Prize includes: 

  • Two (2) return airfares (economy class) from either Karratha or Port Hedland to Broome, Western Australia with Nexus Airlines. 
  • Three (3) nights accommodation at Seashells Broome, valid until 31 March 2025, except for the period 21 December 2024 to 4 January 2025
  • The Prize does not include any spending money 
  • The Prize does not include transfers to Karratha or Port Hedland airport.  
  • The Prize is valued at up to $3,500
